Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, there was no enforcement of the written policy stating that employees must use seatbelts when operating the powered industrial truck. LOCATION: Throughout. VIOLATION: The employer did not enforce the company policy stating that employees use a restraint system when operating the powered industrial trucks.One powered industrial truck, Cat Mod V60R was not equipped with a restraint system. One feasible and acceptable method tocorrect the hazard is to take advantage of the manufacturers retrofit program.
