29 CFR 1910 Section 5 (a) (1) of the Occupational Safety & Health Act of
1970: and the: Vermont Statutes : TITLE
21 Labor: CHAPTER 3. SAFETY: Sub-chapter 5: Occupational Safety and
Health:  223. Duties. (a): The
employer did not furnish to each of his employees employment and a place
of employment which are free from
recognized hazards that are causing or are likely to cause death or
significant physical harm to his employees; and
the employer shall comply with safety and health standards promulgated
under the VOSHA Code.
Location: Long Hold 'G' area of the warehouse
Violation: The employer did not furnish each of the employees employment
and a place of employment which are
free from recognized hazards in that employees were exposed to hazards of
crushing injuries related to fork lift tip
and roll overs due to the lack of use of the provided seatbelts by
operators on the Hyster Fork Lift and the Crown
Fork Lift.
Among other methods, feasible and acceptable methods to correct the
hazards
include but are not limited to: (a):
a hazard assessment and/or pre inspection procedure that will evaluate a
safe operation that includes but not limited
to a check list prior to operating the fork lift to be deployed as to
identify the importance of the use of seat belts,
their function and serviceability; (b): Overhaul or  refocus the fork lift
training program that is facilitated by the
employer that should include a specific focus of seat belt use by
employees, a focus on the  related hazards, and the
safe advantages of using seat belts while operating a fork lift.
