21 VSA Title 23, chapter 3, Sub-Chapter 5, Section 223(a):  Section
5(a)(1) of the Occupational Safety and
Health Act of 1970:  The employer did not furnish employment and a place
of employment which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to potentially overloaded storage racks that
had damaged support legs.
Location:  Storage rack areas
Violation:  The employer did not furnish each of the employees employment
and a place of employment which
is free from recognized hazards in that employees were exposed to hazards
from loaded storage racks where
the support legs had been damaged thereby potentially reducing the
capacity and creating the possibility of
collapse of the damaged sections.
Among other methods, one feasible and acceptable method to correct the
hazards include but are not limited
to: (a): a hazard assessment of the damaged racks to include an evaluation
of the capacity of the racks and if
said capacity has been reduced; (b): Replacement of the damaged support
legs with new or manufacturer
approved types of repairs that will provide equal or better support to
include protective devices that will
prevent future damage.
