Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational
Safety and Health Act
of 1970:  The employer did not furnish employment and a place of
employment which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm to
employees in that, employees were standing in the bucket of an
excavator(330 Cat) and were
they suspended beneath a bridge to perform deck reconstruction.
LOCATION: Church St.
VIOLATION: Employer exposed employees to falling hazards while they were
suspended
beneath a bridge performing deck reconstuction.Manufacturer states that
riders on machines are
subject to injury and riders also interfere and compromise safe operation
of the excavator (JD
330LC). The employees were not using fall protection systems. The use of
aerial lifts in
accordance with 1926.453 would have reduced the hazards to the employees.
