Title 21 VSA Chapter 3, Sub chapter 5, Section 223a of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were not required to use seatbelts when operating the powered industrial trucks nor were the use of seatbelts enforced at the work locations. Location: warehouse Violation: The employer did not enforce the use of seatbelts by the employees when operating a forklift equipped with roll over protection, resulting in the employee being crushed by the forklift when it rolled over and the employee was not retained inside the protective cage.ctive
