29 CFR 1910 Section 5 (a) (1) of the Occupational Safety & Health Act of
1970: and the: Vermont Statutes :
TITLE 21 Labor : CHAPTER 3. SAFETY : Sub chapter 5. Occupational Safety
and Health :  223. Duties.
(a): The employer did not furnish to each of his employees employment and
a place of employment which are
free from recognized hazards that are causing or are likely to cause death
or significant physical harm to his
employees; and the employer shall comply with safety and health standards
promulgated
under the VOSHA
Code.
Location: Lot #31 Overlake View, Williston
Violation: The employer did not furnish to each of his employees
employment and a place of employment which
are free from recognized hazards that are causing or are likely to cause
death or significant physical harm to his
employees; by failing to execute a job safety hazard assessment to
determine the safe method of lifting the exterior
wall in a  manner by either assigning an adequate number of employees, or
the use of mechanical lifting equipment
such as a boom truck or a crane, or other means. The lack of a job hazard
assessment and planning yielded a
manual unsuccessful lift of the pre-fabricated wooden structure
residential exterior wall,  fabricated to the length
of 52 feet, and the height of 9 feet, hand lifted by the four employees
which lead to the injury of two employees
when the wall became unstable and collapsed where one employee received a
fractured ankle and the other a
laceration to the spleen which was removed in surgery following the
accident.
Among other methods, feasible and acceptable methods to correct the
hazards include but are not limited to:
(a): Perform a job hazard assessment and/or pre inspection procedure that
will evaluate a safe operation that
includes but not limited to a check list of safety factors prior to
engaging employees in the manual lift of the
exterior wall ensuring safe work practices and safe conditions.
