Title 21 V.S.A. Chapter 3, Subchapter 5, Section 223 (a), Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause death or serious physical harm to employees, in that employees were exposed to: Location: Main Parking area in front of the power plant. Violation: Inspections of both the frequent and periodic variety, as required under 29 CFR 1910.180 paragraph (d), 1926.550 paragraph (b), and ANSI B30.5-1968 section 5-2.1, (as incorporated by reference) was not completed for the Link Belt, model HC 78A, lattice-boom, truck style crane, which was used by employees for the purpose of dredging sediment from the area in front of the power dam. Among the more feasible and usable ways to abate this hazardous condition, is to institute a documented program of inspection as required under 29 CFR 1910 (d) (1) - (6), for critical parts of the crane which are deemed integral to the safety of employee operators and other exposed employees.
