21 VSA Title 2, Chapter 3, Sub-chapter 5, section 223(a): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or significant physical harm to his employees in that employees were working in the zone of danger of a lift truck counterweight that exposed employees to a crushing hazard. Location: Service maintenance area at the Liftech Equipment Companies, Inc. work site located at 33B Commerce Ave., South Burlington, Vt. Violation: The employer did not furnish to each of his employees employment and a place of employment which was free from recognized hazards that are causing or likely to cause death or significant physical harm to his employees in that employees were working in the zone of danger of a lift truck counterweight weighing approximately 4,800 pounds that was placed on two portable automotive lifting devices (jack stands) adjacent to the employees work area which exposed the employees to a crushing hazard when the counterweight fell and struck an employee. A feasible and acceptable method of abatement is to remove the counterweight from the work area and either place it flat so it has no potential to fall or secure the counterweight with appropriate materials so that it cannot fall.

21 VSA Title 2, Sub-chapter 5, section 223(a): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or significant physical harm to his employees in that the employer did not ensure that after a 4,800 pound lift truck counterweight had been removed that it was cribbed, blocked or otherwise secured at once which exposed employees to a crushing hazard. Location: Service maintenance area at the Liftech Equipment companies, Inc. work site located at 33B Commerce Ave., South Burlington, VT. Violation: The employer did not ensure that after the lift truck counterweight weighing approximately 4,800 pounds had been removed from the Hyster Lift Truck and placed on two portable automotive lifting devices(jack stands) that it was cribbed, blocked or otherwise secured at once which exposed employees to a crushing hazard when the counterweight fell and struck an employee. A feasible and acceptable method of abatement is to remove the counterweight from the work area or to ensure the counterweight was cribbed, blocked or otherwise secured at once so that it cannot fall.
