Section 5(a)(1) of the occupational safety and health act of 1970: The employer
did not furnish to each of its employees employment and a place of employment fr
ee from recognized hazards that cause or are likely to cause death or serious ph
ysical harm to its employees in that employees were exposed to crushing hazards
from unsecured electrical cabinets (MPC units) provided and installed by other c
ontactor(s): STS Ramp on Northbound side: A 700 pound electrical cabinet (MPC un
it) containing high and low voltage was placed on a narrow elevated curbing walk
way 36 inches above the roadway by other contactor(s) without it being secured t
o the walkway. On or about May 31, 2002, the MPC unit tipped over and fell on an
electrician who was working on the MPC unit from the roadway surface.
