Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with working inside a confined space and being trapped inside during a tunnel fire or emergency. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform a job hazard analysis (JHA) to maintain proper communication, safe emergency egress, and a non hazardous atmosphere. C17A2, tunnel ceiling compartments: 1. Employees entering the confined space through hatch into bulkhead compartment, in order to rust proof structural steel webs, did not have adequate two-way means of communication. 2. Employees were without a means of egress after the scissor lift transported them to their work location and left the area. 3. Initial evaluation was not performed on the confined space to determine whether or not it was a permit required confined space.
