Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to the hazards associated with a) being struck by shotcrete hoses and its material not adequately repaired, and b) failure of guardrail systems not adequately installed. One feasible method of abatement amongst others would be to develop and implement an inspection and maintenance program for frequent and regular inspections of equipment and materials by a competent person, who would recognize unsafe conditions and would have the authority to immediately remove the hazards, and make the adequate repairs following manufacturer's instructions for repairs and installation. a) Russia Wharf, NATM Tunnel: 1. An employee was using a damaged shotcrete hose that was bandaged together with a piece of a hose and tie wire instead of adequately replacing the damaged section with a new section of hose as required by the manufacturer. 2. An employee was operating a shotcrete hose having a broken water control valve. The employee was using the emergency water pressure valve to control the water flow. b) Russia Wharf, above ground: The guardrail sections of the Garlock system were not equipped with any locking pins which interlock the vertical posts to its supporting steel base.
