Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:12/09/02 Condition:An employee operating a Caterpillar 928G Wheel Loader in the Yard, Tipping and Pit areas was not trained nor evaluated to ensure that he was copetent to operate the equipment safely. (b)Date of Violation:12/09/02 Condition:Employees working in the Yard, Tipping and Pit areas were not trained in the recognition and avoidance of hazards associated with working in close proximity to heavy equipment and to truck traffic. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that only employees who have been trained and evaluated and found to be competent to operate heavy equipment safely be permitted to operate equipment such as the Caterpillar Wheel Loader, and that all employees who work in close proximity to heavy equipment and truck traffic be trained to recognize and avoid hazards associated with working around this equipment. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
