Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to a fall hazard while working in the loader bucket of a bobcat:
a)Construction site, 24 Bradhurst, NY NY
On or about July 11, 2002
An employee was performing masonry work from a Daewoo 2060XL bobcat
loader elevated approximately 8 feet from the ground.
Among other methods, one feasible and acceptable method to eliminate this
hazard
would be to 1)  provide training for all personnel required to use skid
steer
loaders including hands on training and supervised on the job training,
and 2) the
use of an appropriate portable ladder to access the elevated area.
NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY
DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT
SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS
VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
