Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by free-standing steel pilings. a)At the construction site, on the roof, 1725 1st Avenue, New York NY On or about August 19, 2002 Employees were exposed to the failure of a material handling device supporting a precast concrete wall section whose weight exceeded the device's rated capacity. Among other methods, feasible and acceptable methods to correct this hazard is to: a) Support and secure the precast concrete wall section with an appropriate material handling device rated and capable of supporting the weight of the precast wall sections. b) Barricade the area under and around where the wall sections is being supported to prevent access of workers not involved with the installation/adjustment procedure. NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1910.19.ce
