Health
Act of North Carolina:  The employer did not furnish to each of his
employees
conditions of employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees:
a)facility wide -- below-the-hook lifting devices were not tested
prior to their initial use.
REFERENCE:  ANSI B30.20-1985, Chapter 20-1.4, Testing
Prior to initial use, all new, altered, modified, or
repaired lifting devices shall be tested to ensure
compliance with this standard.
NOTE:Among other methods, one feasible and acceptable method to correct
this hazard is to have all below-the-hook lifting devices tested.

is visible.

The rated load of the lifting device shall be marked on the
main structure where it is visible.

hoists in the facility were/are not being tested before
each operator's shift.
REFERENCE:ANSI B30.11-1998, Section 11-2.2, Testing,
Paragraph 11-2.2.1, Operational Tests
NOTE:Among other methods of abatement of this hazard is
to test each hoist upper limit switch before each
operator's shift.
OR IN THE ALTERNATIVE:
29 CFR 1910.179(n)(4)(i):  At the beginning of each operator's
shift the upper limit switch of each hoist was not tried out
under no load.
