Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: In the back or the repair shop: This employer had employees exposed to a possible struck by hazard due to having a lifting device available for use that had a 3 ton, Duff Lynx, Model LHH-3B overhead hoist installed on a supporting structure that was rated at only 2 ton. ANSI Standard B30.16-1973, Paragraph 16-1.1.3.1 states that the supporting structure shall have a load rating at least equal to that of the hoist. "ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS": Install the overhead hoist on a structure that has a load rating that is at least equal to that of the hoist.
