A.R.S.23-403 (A): The employer did not furnish to each employee employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to the employees from the employer's failure to require all operators of power industrial trucks that are equipped with operator restraint devices, including seat belts, to use the devices while operating such trucks. Both the ANSI B56.1, consensus standard for powered industrial trucks, and ASME B56.1-2000 - Safety Standard for Low Lift and High Lift Trucks, recognize the hazard of forklift tipover and the need for operators to use an operator restraint system, such as seat belt. a) 44376 Vicksburg Rd., Salome, AZ - Caterpillar # 1: The employer failed to require employees who were operating forklifts to wear a seat belt while operating the forklifts. Employees (at least 3 observed at the time of this inspection) were not wearing their seat belts, which were provided by the forklifts' manufacturer as standard equipment. It is a well-known preventive practice in the industry to wear seat belts to prevent injuries to operators in the event of a tipover accident. b) 44376 Vicksburg Rd., Salome, AZ - Caterpillar # 5: The employer failed to require employees who were operating forklifts to wear a seat belt while operating the forklifts. c) 44376 Vicksburg Rd., Salome, AZ - Caterpillar # 10: The employer failed to require employees who were operating forklifts to wear a seat belt while operating the forklifts.
