Nevada Revised Statute 618.375 (1):  The employer failed to furnish
employment and a place
of employment which was free from recognized hazards that were causing or
were likely to
cause death or serious physical harm to his employees:
The employer failed to ensure that employees had knowledge of the Genie
material lift, model
SLC-24, for proper operation to recognize tip-over hazards, as follows:
a.Cancun Resort, Building #3, sub-terrain parking area, electrical room,
north wall,
employees had raised A/C unit to the ceiling with the Genie lift, model
SLC-24.
The lift was placed on a concrete slab for electrical equipment with
extended
front legs to hold the unlevel load and the lift.  The material lift was
not on a
firm, level surface.  The stabilizers were not utilized and blocks were
used in an
attempt to partially level the front legs.

Rules/tip over hazards:  Do not raise the load unless the stabilizers and
legs have
been fully lowered and locked and the casters are in full contact with the
ground.
Do not use blocks to level the machine.
One feasible and acceptable abatement method, among others, to correct this
hazard would be:  1) Ensure that stabilizers are attached prior to the
load being
raised; 2) Fully train each employee in accordance with Genie Superlift
Operator's Manual prior to the lift being used; and, 3) Maintain the
Operator's
Manual with the lift for employee reference.
