Section 88.4 Code of Iowa (2003)
88.4:  The employer did not furnish employment and a place of employment
which was free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
(a)Body Shop - In the building there were two, 3 ton, electrically
operated,
overhead chain hoists (underhung) being used by employees to remove truck
beds on a non-routine basis. The employer did not have an inspection
schedule
for each hoist. Among other methods, one feasible and acceptable method to
correct this hazard is to have a qualified person, knowledgeable of the
hoist
inspection requirements which are detailed in  ASME B30.16-1993 Chapter
16-2, Section 16-2 - Inspection, Testing, and Maintenance, conduct the
necessary inspection at the required intervals.
