North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls greater than six feet when using improperly constructed job made ladders [Reference ANSI A14.4-1979, paragraph 4.5.2]: a)building 12, ground floor: a job-made ladder, approximately 114" tall and constructed without the filler blocks inserted between the cleats, was available for use by employees who were framing the building. b)building 11, third floor: a job-made ladder, approximately nine feet tall and constructed without the filler blocks inserted between the cleats, was available for use by employees who were installing braces on the trusses. c)building 11, third floor: a job-made ladder, approximately ten feet high and constructed without the filler blocks inserted between the cleats, was used by employees to access the trusses, approximately nine feet above the floor, to install braces on the trusses.
