North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not trained to recognize and protect themselves against fall hazards and were exposed to falls greater than four feet: a)storage area re-set: an employee was observed painting a display while standing on the second level of the shelving unit, approximately 90" above the concrete floor, without any type of fall protection in use. Among other methods, one feasible and acceptable means of abatement would be to install some type of fall protection for employee use.
