North Carolina General Statue S95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility, production - where employee(s) were allowed to stand in close proximity of and reach underneath of an overhead hoist and its appurtenance that was not load rated. Employee(s) used hoists such as, but not limited to, a Dayton, 300 pound load rated, model #358B, to hoist loads, i.e., ventilation fans and equipment. One feasible and acceptable abatement method, among others, to correct this hazard is to load rate the hoists and appurtenances to ensure that they can withstand the rated load capacity.
