North Carolina General Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish each of his employees conditions of employment and a
place of employment free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to a struck by hazard:
a)131 Ileagnes Road - where a pneumatic stationary
automotive lift was being used during mechanical work
and inspections, safety and warning labels were not
available, periodic inspections were not being
conducted, and preventative maintenance was not being
performed.  REF: ANSI/ALI ALOIM-2000, Standard for
Automotive Lifts - Safety Requirements for Operation,
Inspection and Maintenance.
b)facility, body shop - where a pneumatic Cheetah frame
machine (roll on type superstructure) was used to lift
vehicles in order to test the vehicle frame and to lift
above the ground for servicing, safety and warning
labels were not available, periodic inspections were
not being conducted, and preventative maintenance was

ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS
HAZARD IS TO FOLLOW PROCEDURES LISTED IN ANSI/ALI ALOIM-2000, TO
INCLUDE DETERMINING THE CAPACITY OF THE LIFTS, HAVING THE LIFTS
INSPECTED BY A QUALIFIED PERSON, AND DEVELOPING A PREVENTATIVE
MAINTENANCE SCHEDULE.
