North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)yard- where employees risk being struck by moving equipment due to an employee operating a Kawasaki L-32 front-end loader with an attached bucket to push a railroad car into an off loading position. Among other methods, two feasible and acceptable methods to correct this hazard would be to use a manual railroad car mover or a powered freight car mover to move the railroad car and to train the equipment operator on the limitations of the front-end loader.
