North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)site - employees were allowed to use a home-made box for lifting personnel with a John Deere model 482C fork truck. The box was missing most of the required safety features and was not approved by the fork truck manufacturer. (Reference: ASME B56.1-1993, Parag. 4.17 - 4.35.4) Among other feasible methods to correct this, the employer could use man-lift machines, designed for the purpose of lifting personnel.
