North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees conditions
of employment and a
place of employment free from recognized hazards that were causing or
likely to cause death or
serious physical harm to employees in that employees were exposed to a
crushing hazard:
The hydraulic automotive lift which traveled in excess of 36 inches was
not equipped with an
automatic mechanical device to hold the lift in the fully extended
position (ANSI B153.1-1981
Sec. 3.2.1);
The employer did not display the operating instructions for the hydraulic
automotive lift, in a
conspicuous location in the lift area (ANSI B153.1-1981 Sec. 6.2.1):
a)automotive work bay, behind Mr. McCoy's office - 8,000 lb. capacity,
hydraulic
and air automotive lift, manufactured by Western Hoist, Inc., raised 2,600
lb. ST-10 Chevy Blazer, 5 ft. 5 inches above the bay floor, mechanical
locking
device was
malfunctioning and would not hold the load for an extended period of time.
One feasible and acceptable method of abatement, among others, to correct
this hazard is to
install a newer model hydraulic lift, which  is equipped with an automatic
mechanical device, that
will hold the load in the fully extended position, when the lift travels
in excess of 36 inches.
