North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of
North Carolina: The employer did not furnish each of his employees
conditions of
employment and a place of employment free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to:
a)site - employees were allowed to use vehicle mounted elevating and
rotating
aerial devices (bucket trucks #444, 451, and 462) that had not been
periodically inspected (at least every 12 months)and tested for compliance
with
the rating of the aerial device in accordance with one of the applicable
methods and procedures as outlined in section 5.4.3 of the standard. (REF:

b)site - employees were allowed to use vehicle mounted elevating and
rotating
aerial devices (bucket trucks #444, 451, and 462) that had but one record
of
periodic inspections despite the requirement to keep records for at least 5
years. (REF: ANSI/SIA A92.2-2001, para 8.3(2).
Among other feasible methods to correct this, the employer could set up a
periodic
maintenance program that would require inspections and maintenance of
supporting
records on an annual basis.

not
been periodically inspected and tested (at least every month). Test dates
indicated on the gloves in use included 02/02, 03/02 and 09/02 despite the

b)site - employees were allowed to use high voltage rubber sleeves that
had not
been periodically inspected and tested (at least every 3 months). Test
dates
indicated on the sleeves in use included 02/02, 02/02, and 08/02 despite
the
company requirement for testing every 3 months.   (REF: River City

c)site - employees were allowed to use rubber blankets that had not been
periodically inspected and tested (at least every 6 months). Test dates
indicated
on the blanket in use included 05/00 despite the company requirement for

d)site - employees were allowed to use rubber hose that had not been
periodically inspected and tested (at least every 6 months). Test dates
indicated
on the hose in use included 11/99, and 10/00 despite the company
requirement

Among other feasible methods to correct this, the employer could set up a
periodic
maintenance program that would require inspections and testing based on
the time
table specified in the companys safety manual.
