North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees conditions
of employment and
a place of employment free from recognized hazards that were causing or
likely to cause
death or serious physical harm to employees in that employees were exposed
to:
a)jobsite/facility-  no preventative maintenance had been carried out on
the
Ingersoll-Rand model SP-42, serial 270-C Vibratory Compactor from the date
of purchase to identify and correct hazards, such as:  lack of operable
emergency (foot) brake and parking brake on and before August 29, 2002 that
contributed to the operator's inability to stop the compactor before it
struck the
creek bank.
Among other methods, one feasible and acceptable method to correct this
hazard is to
initiate a preventative maintenance program for all motor vehicles and
equipment that
allows for inspections, based on time, of the equipment to identify safety
and
operational problems with the equipment.l
