North Carolina General Statute 95-129(1): of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the unguarded blade of the Banbury guillotine during non-cycling operations. The employer had not instructed each Spanish speaking employee in the recognition and avoidance of unsafe conditions and regulations applicable to his/her work environment to control or eliminate any hazards or other exposure to illness or injury through training: 1. In that the Banbury guillotine (employer manufactured) was not inspected on a regular interval and documented, such as every 60 days, and kept in good working condition at all times. Inspections of the machine did not include alignment, adjustment, and security of the blade shaft with the operating power cylinder shaft. 2. The operators manual (employer developed) had not been translated into Spanish or in a way that Hispanic employees would have understood the operation of the machine; 3. The operators manual (employer developed) did not include "Danger and Caution" notes or warning symbols (such as hand with RED circle and line thru hand) indicating a way that operators (Hispanic) to prevent exposing their body parts to possible injury; 4. The operators manual (employer developed) did not include training on the usage of a special tool for the removal of material within the danger zone. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees in Spanish on how to properly operate the "Banbury" guillotines.
