General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)being struck by or caught in between the loader/tamp and the ground in the event employees fall or get thrown off. The employees operating the Caterpillar Loader and Ingersoll Rand Tamp were exposed to being caught in between/crushed from not using the installed seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train/certify and inspect employees on wearing seatbelts installed by the manufacturer of the Caterpillar Loader/Ingersoll Rand Tamp.
