North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)being struck or caught in between the lift and ground in the event the employee fell off or was thrown off. The employee operating the Lull Forklift, model 644B-42, was exposed to being caught/crushed from not using the installed seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train/certify and inspect employees on wearing seatbelts installed by manufacturer of the Lull forklift.rer
