North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment
and a place of employment free from recognized hazards that were causing
or likely to cause
death or serious physical harm to employees, in that employees were
exposed to:
a) being caught between the model 5010, Ditchwitch's ROPS and the ground in
the event the vehicle was up-set or turned over.  The operator was not
wearing the
installed seat belts while operating the vehicle. The installed seat belts
had fallen
underneath the vehicle's seat and were covered with a heavy layer of dirt.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard was to require the operator to wear the installed seat belts while
operating the
Ditchwitch.
