Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by the arm of the Komatsu PC2000 Hydraulic Excavator, Serial # A82218. a) Job site, 70 Roaring Brook Road: Employee operating a Komatsu Hydraulic Excavator created the hazard of striking other employees working in the area with the arm and bucket of the excavator, on or about 07/14/03. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to... 1. Follow the Komatsu Hydraulic Excavator "OPERATOR'S MANUAL" that comes with this equipment. Page 2-64, 12.7 SWINGING-" WARNING-When operating the swing, check that the area around the machine is safe." " Instructions, 0-2, "To avoid accidents, read, understand and follow all precautions and warnings in this manual and on the machine before performing maintenance and machine operations".
