Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in that:
a. At the jobsite, an employee painting from a Genie S-40 aerial lift
serial number 205554, was exposed
to a 20 foot fall hazard in that the employee was not utilizing a
restraint device while working from
the inside of the aerial lift basket.
One means of feasible abatement would be to comply with the American
National Standards Institute,
ANSI A92.5-1992, Standard for Boom-Supported Elevating Work Platforms.
