Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)George Moore Trucking & Equipment- on or about 12/11/03- two employees were exposed to slipping and falling approximately (7') seven feet to ground level when working out of a bucket of a Caterpillar front end rubber tired loader. Methods to correct this hazard include: 1) Develop and implement a comprehensive safety and health training program for employees on the proper use of heavy equipment. 2) Adhere to Caterpillar manufactures recommendations in the Safety Section of the operators manual and not allow riders on the equipment unless additional seats with proper safety equipment have been installed.
