A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that restraining devices (i.e. seat belts) were installed on each forklift to restrain the operator in the event of a rollover. (a) 5441 West Hadley Street, Phoenix, AZ: One (1) employee was operating a Toyota forklift, model #42-5FG25, serial #405FGU25-79790, without wearing a restraining device (i.e. seat belt). (b) 5441 West Hadley Street, Phoenix, AZ: One (1) employee was operating a Toyota forklift, model and serial numbers unknown, without wearing a restraining device (i.e. seat belt).
