Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fire hazard: NFPA 35 1970 Chapter IV Process Equipment and Operations:1450. Where solvents are pumped from storage to points of use, an emergency switch shall be provided in the processing areas at the normal exit door and at the pumps to shut down all pumps in case of fire. Paint Room: Where flammable liquids were transferred from underground storage tank directly to process vats, no emergency switches were provided to shut down the pump.
