Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: fall hazard at the ten and twenty foot levels when
unloading equipment off the
platform of an equipment elevator lift.
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
(a)Outside Front of New Building - Two employees performing carpentry work
from
the basket of the JLG aerial lift #439739 were not wearing personal fall
arrest
systems (body harness/lanyard), thereby exposeing them to a fall hazard of
approximately eighteen (18) feet to the ground below, on or about October
8,
2002.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
includes using a personal fall arrest system, with the lanyard attached to
the boom or basket of
the personnel lift, as outlined in the American National Standards
Institute Safety Standard for
Boom Supported Elevated Work Platforms (ANSI/SIA A92.5-1992).
OR IN THE ALTERNATIVE:
29 CFR 1926.453(b)(2)(v):   Employee body harness and lanyard assembly was
not attached to
the boom or basket when working from an aerial lift:
(a)Outside Front of New Building - Two employees performing carpentry work
from
the basket of the JLG aerial lift #439739 were not wearing personal fall
arrest
systems (body harness/lanyard), thereby exposing them a fall hazard of
approximately eighteen (18) feet to the ground below, on or about October
8,
2002.
