Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
(a)John Beck Elementary - Two (2) employees were welding on the structural
steel
approximately 20 feet above the ground, from the platform of a Grove
Manlift
and from a 40HY JLG self-propelled telescoping stick boom personnel lift.
The
employees were wearing personal fall arrest systems, but were not tied off
to the
lift, on or about October 31, 2002.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
includes using a personal fall arrest system, with the lanyard attached to
the boom or basket of
the personnel lift, as outlined in the American National Standards
Institute
safety standard for
Boom-Supported Elevated Work Platforms (ANSI/SIA A92.5-1992).
OR IN THE ALTERNATIVE
29 CFR 1926.453(b)(2)(v):  Employee body harness and lanyard assembly was
not attached to
the boom or basket when working from an aerial lift.
