Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall hazard at the ten and twenty foot levels when unloading equipment off the platform of an equipment elevator lift. (a)Press Shop - The foot treadle on the Chicago fifteen (15) ton mechanical press brake was not provided with a means to inhibit unintentional actuation, on or about January 2, 2002. (b)Press Shop - The foot treadle on the Chicago thirty five (35) ton mechanical press brake was not provided with a means to inhibit unintentional actuation, on or about January 2, 2002. One feasible means for abatement of this item among others is to provide a protective cover over the treadle or provide a locking pin or locking lever to lock the treadle bar in a fixed position. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by the unprotected foot treadle(s) on the press brake(s): (a)Press Shop - The foot treadle on the Chicago fifteen (15) ton mechanical press brake was not provided with a means to inhibit unintentional actuation, on or about January 2, 2002. (b)Press Shop - The foot treadle on the Chicago thirty five (35) ton mechanical press brake was not provided with a means to inhibit unintentional actuation, on or about January 2, 2002.
