Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing type injury from press brake operations: (a)Shop - The foot pedal on the Cincinnati thirty (30) ton mechanical power press brake was not provided with a means to inhibit unintentional actuation, on or about October 23, 2003. One feasible means for abatement of this item among others is to provide a protective cover over the pedal or provide a mechanical locking pin. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by the unprotected foot pedal(s) on the press brake(s): (a)Shop - The foot pedal on the Cincinnati thirty (30) ton mechanical power press brake was not provided with a means to inhibit unintentional actuation, on or about October 23, 2003.
