Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from the unintended actuation of a foot pedal/treadle, not provided with a guard: (a)No. 2 Forge Building - An employee operated a forge press with an unguarded foot pedal, on or about April 9, 2004. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO GUARD THE FOOT PEDAL. *** Or In The Alternative *** 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by an unguarded foot pedal. (a)No. 2 Forge Building - An employee operated a forge press with an unguarded foot pedal, on or about April 9, 2004. VERIFICATION REQUIRED
