Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall from an elevation and/or crushing hazard when
working from a self
propelled elevating work platform (scissor lift) that was not properly
maintained and inspected.
(a)Receiving Area, Behind Store - Employees utilized a JLG, Model 25 MSE,
self-
propelled scissor lift to load furniture to and from the second floor of
the
warehouse eight (8) feet, three (3) inches above grade.  The scissor lift
had a flat
tire and was not positioned on a level supporting surface prior to being
raised, as
observed, on or about December 13, 2004.
Among other methods, one feasible and acceptable abatement method to
correct these hazards
include: The user shall assure that powered platform lifts are properly
maintained and inspected
in accordance with the manufacture's Operations and Safety Handbook and
the American
National Standard Institute for Self-Propelled Elevating Platforms,
ANSI/ASI A92.6 -1999,
including but not limited to, Section 7.3 (Inspection and Maintenance),
Section 7.3.3 (Prestart
Inspection), Section 7.6 (Operator Training), Section 7.7 (Before
Operation), Section 7.8
(Workplace Inspection), Section 7.9 (Before Operation), Section 7.11
(Warnings and
Instructions) and Section 7.15 (Record Retention).
