Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
(a)East Side of Building - Two employees hung panels, approximately 25
feet above
the ground, from the platform of a self-propelled telescopic stick boom
supported
aerial lift.  These employees did not use personal fall arrest systems
while
working from the lift, on or about December 21, 2004.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
includes using personal fall arrest systems, with the lanyards attached to
the boom or basket of
the personnel lift, as outlined in the American National Standards
Institute safety standard for
Boom-Supported Elevating Work Platforms (ANSI/SIA A92.5-1992).
OR IN THE ALTERNATIVE
29 CFR 1926.453(b)(2)(v):  Employee body harness and lanyard assembly was
not attached to
the boom or basket when working from an aerial lift:
(a)East Side of Building - Two employees hung panels, approximately 25
feet above
the ground, from the platform of a self-propelled telescopic stick boom
supported
aerial lift.  These employees did not use personal fall arrest systems
while
working from the lift, on or about December 21, 2004.
