Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fire hazards associated with the improper use and
placement of asphalt (tar)
kettles and propane tanks:
a) The asphalt (tar) kettle provided for employee use during roofing
operations was used on the
roof of a 7 story building and was left unattended while being fired by
propane.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply
with the BOCA National Fire Prevention Code/1999, Standard for asphalt
(tar) kettles, Section
F405.2, and prohibit asphalt (tar) kettles from being used on roof decks
or left unattended while
fired.
b) The employer stored approximately 13, 100 lb LPG cylinders on the roof
of the 7 story
building where employees were engaged in roofing operations.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply
with the BOCA National Fire Prevention Code/1999, Standard for the
protection and storage of
LPG cylinders, Section F405.4, and prohibit the storage of LPG cylinders
upon roof tops.
