Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing from equipment rollover: (a) Hong Phatt Plaza, west side of Jonesboro Road (address not established) grading site 75 feet of NW corner- On or about 12/4/02, employees were grading a nonresidential construction site while operating a HYPAC C832 Series Single Drum Padfoot Vibratory Compactor, SN B208C1846J, without wearing a seat belt. Hazard of being crushed by equipment. One feasible abatement method used by this industry is to ensure that Rollover Protection Structures (ROPS) and seat belts are installed on the compactor and that the operators are required to use the seat belt, or to limit the equipment to terrain where a rollover hazard does not exist. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIREDATION
