Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by an excavator bucket: (a) 9725 Autrey Mills Road, Alpharetta, GA, water treatment plant under construction - An employee was working underneath the bucket of a Caterpillar 320B L excavator. Employee was exposed to a hazard of being struck by digging/lifting equipment, on or about 06/20/03. Among other methods, one feasible and acceptable method to correct this hazard is: (1) Prohibit all employees from working underneath lifting/digging equipment. ABATEMENT CERTIFICATION AND DOCUMENTATION NOT REQUIREDATION
