Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls to ground level: (a) Outside of milling area - An employee was standing on the forks of a lift approximately 8-10 feet high, disposing of a large box of waste from the milling operation. This action was performed without the use of a properly constructed safety platform attached to the forks. This created a fall hazard to the ground level below. Among other methods, one feasible and acceptable method to correct this hazard is: (1) Provide a safe, properly guarded platform which does not require the usage of a forklift. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
