employer did not furnish to each of his employees
employment and a place of employment which were free from recognized
hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to
malfunctioning automotive equipment.
(a) Automotive Bay 2, Shop area - On or about November 7, 2003, employees
were operating a Magnum Wheeltronics
Twin Post 9,000 lb capacity lift, Model A-9K, SN 81776A, with an improper
cable assembly and a broken safety lock.
Hazard of being struck by or caught in equipment.
(b) Automotive Bay 3, Shop area - On or about November 7, 2003, employees
were operating a Ben Pearson
Tubemaster 12,000 lb capacity 4 post lift, Model 12000-4MR, SN 08006764,
with a missing lift safety lock stop bolt.
Hazard of being struck by or caught in equipment.
Among other methods, one feasible and acceptable method to correct this
hazard is to take both lifts out of service
until the safety locks and bolts are repaired or replaced following the
manufacturer's
recommendations before returning
to service.
