Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck and crushed by moving machinery: (a) Burning Department - Employees performing operator (fireman) assignments in the pre-dry, dryer and kiln area, were exposed to the hazard of being struck by moving kiln cars. Automatic shut offs or other means, such as emergency shutoff, were not available to safeguard operators in the event of an emergency. On about 11/21/03, a fireman operating #2 dryer was pulled into the dryer and trapped/crushed between kiln cars containing approximately 1700 pounds of bricks. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: (1) Install an automatic and/or emergency shutoff to inhibit the systems operation in the event of an emergency. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
